Bar Council exam: This is a gross misconduct of “management”

By “management” I meant the whole procedure, involved organization and their administrative body and every personal entity who is a stakeholder of this unplanned rather malaise situation. More than thousands of students are deviated and dreary about the Bangladesh Bar Council’s denial of the right to sit for the enrollment exam.

Honorable HCD gave direction about the limitation of availability for pursue a LLB degree in private Universities. The reason behind this decision was the demand of eminent candidate in enrollment procedure. It was in 2017. Unfortunately, more than the limitation of availability, students were admitted by some of the private universities. As we saw, UGC had been declared and published several notices regarding the illegality of private universities but there were no “several” and “concerned” notice published by Bangladesh Bar Council quod to this bar and limitation of admission.

A HSC passed student is not liable of being admitted by universities without any circumspection of this situation. I repeat A HSC passed students, with an energetic heart, with lots of vision to serve his country, his people, his vow to justice is not LIABLE. This is a gross misconduct of administrative body of respective universities.

But did Bangladesh Bar Council serve justices to the students till now? A promise to take enrollment exam in every six months is not fulfilled by them yet. Isn’t is the violation of the judgment given by HCD and its own regulations? The query of bar council regarding the development of quality among the students is quite wise and noble step but did they forgot the law of equity? “He who comes into equity must come with clean hands”. I see a red hand which is clearly not clean. If this enrollment exam would have held in due time in every year, this worst situation would never come.

Question can be arised in several perspectives, to get admitted in any LLB honors degree, there is no central authority to observe and organize the admission process such as medical and dental admission process. Most of the universities run their courses in trimester system. So, the limitation of 50 seat is not quite effective, because it is incomprehensible to aggregate annual admission policy.

If there is no prescribed policy to admit 50 “eminent” students then how come this limitation is not responsible to be a logical fallacy. This is totally a systematic chaos, which endanger the future of thousands of students.

Constitution of Bangladesh give its citizens the freedom of profession or occupation. Article 40 of the constitution of Bangladesh provides, “(1) Subject to law, public order and morality- every citizen has the right to profess, practice or propagate any religion; every religious community or denomination has the right to establish, maintain and manage its religious institutions.”

And in respect of the of law, public order and morality, the rules should not be rigid. It should be ease and encouragement to all of the students.  For this chaotic situation, You only you are liable of this situation.

It is my humble request to the proper and concerned authority, do not treat these students like scapegoats. For the sake of our countries justice system. For the sake of a bright future.
