Affidavit must be sworn in within five working days: HC
The High Court has issued directions for swearing of affidavits within five working days after entry in the filing section. Failing this, the Commissioner of Affidavits is barred from accepting any application for the purpose of swearing in the affidavit.
In a writ petition on May 22, The High Court bench comprising Justice Mahmudul Hasan and Justice Md. Mahmud Hasan Talukder gave the order.
In the said order, the court inter alia directed as follows –
as such, it is directed that the affidavit must be sworn in within five working days by the deponent from the date of getting entry of filling the same with the filing section failing which the affidavit commissioner shall not entertain any petition for the purpose of swearing in the affidavit.
the learned registrar general of the supreme court are here by directed to issue instruction/office order regarding filing of the writ petition with filing section and completion of swearing in the affidavit as directed above and also to monitor strictly so that the direction in this regard is maintained by the concerned officials.
